LAZER LAMPS LTD TERMS AND CONDITIONS OF SALE

 

These Terms and Conditions apply to all sales made to consumers through our website, over the telephone, in person and by post.

 

Where to find information about us and our products.

You can find everything you need to know about us, Lazer Lamps Ltd (‘Lazer’), and our products on our website, in our brochure or from our sales team who can be contacted by phone on 01992 677374 or by email on sales@lazerlamps.com before you order. We also confirm the key information to you in writing after you order by email.

 

When you buy from us you are agreeing that:

  • We only accept orders when we’ve checked them.
  • Sometimes we reject orders.
  • We charge you when you place your order.
  • We charge interest on late payments.
  • We pass on some increases in VAT.
  • We’re not responsible for delays outside our control.
  • Products can vary slightly from their pictures.
  • If you purchase the goods to fit to a vehicle yourself, or you will arrange for them to be fitted for you, you are responsible for making sure the product is suitable for fitting to your vehicle.
  • If you have asked us for advice about the fitment for a lamp, you are responsible for making sure that the measurements you give us are correct.
  • If you bought online or over the telephone, you have a legal right to change your mind plus extra rights under our guarantee.
  • You have rights if there is something wrong with the product.
  • We can change products and these terms.
  • We can suspend supply (and you have rights if we do).
  • We can withdraw products.
  • We can end our contract with you.
  • We don’t compensate you for all losses caused by us or our products.
  • We use your personal data as set out in our Privacy Notice.
  • You have several options for resolving disputes with us.
  • Other important terms apply to our contract.

 

We only accept orders when we've checked them.

We will contact you to confirm we've received your order. We will contact you again to tell you when we have dispatched your order, or before that if there are any payment clearing issues. Orders will not be dispatched until cleared funds are received.

 

Sometimes we reject orders.

Sometimes we reject orders, for example, because a product is unexpectedly out of stock, or because you are located in a delivery area that we are unable to deliver to or because the product was mispriced by us. When this happens, we let you know as soon as possible and refund any sums you have paid.

 

We charge you for products ordered through our website or on the phone when you order.

You will own your product once we have received payment in full.

 

We charge interest on late payments.

If we're unable to collect any payment you owe us we charge interest on the overdue amount at the rate of 2% a year above the Bank of England base rate from time to time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You pay us the interest together with any overdue amount.

 

We pass on some increases in VAT.

If the rate of VAT changes between your order date and the date we supply the product, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.

 

We're not responsible for delays outside our control.

If our supply of your product is delayed by an event outside our control, such as industrial action by our suppliers’ staff, fire or flooding at our warehouse, acts of God, war or terrorist activities, we contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won't compensate you for the delay, but if the delay is likely to be substantial you can contact our Customer Service Team on 01992 677374 or by email on sales@lazerlamps.com to end the contract and receive a refund for any products you have paid for, but not received.

If you have asked us to fit a product to a vehicle, we will charge you additional sums if we find out when the vehicle arrives that we are not able to do this easily because you have not given us the correct information about your vehicle or have not checked the information that we gave to you. For example, we might need to adapt our schedule to carry out the fitting service.

 

You're responsible for making sure the product is suitable for fitting to your vehicle.

You are responsible for making sure that our product is compatible with your vehicle. Find information about our product features and specifications on our website and in our brochure, or contact our Customer Service Team: www.lazerlamps.com. We publish installation videos and product instructions on our website www.lazerlamps.com.

We recommend that all our products are fitted by a professional installer, and in order to prolong the longevity of connector joints, we recommend that the connectors are assembled using contact grease.

You are responsible for making sure the product(s) are installed in compliance with local laws and regulations.

Many Lazer products are certified to relevant regulations pertaining to vehicle lighting, including but not limited to UNECE regulations relating to high beam driving lights and position lights. You are responsible for ensuring the installation and use of any products you buy from us is done so in compliance with local laws and all applicable regulations.

Please be aware that mounting extra lamps or other accessories to a vehicle may impact the performance and reliability of the vehicle and its component parts, including but not limited to; (i) wind noise, (ii) engine efficiency and cooling, (iii) robustness and strength of the surrounding or connected parts (i.e. grilles), and (iv) electrical systems. We cannot accept liability for any impact on vehicle performance or reliability caused by fitting our products.

If you bought online, or over the telephone, you have a legal right to change your mind plus extra rights under our guarantee.

 

Your legal right to change your mind.

For most of our products bought online, or over the telephone, you have a legal right to change your mind about your purchase and receive a refund of what you paid for it, including the delivery costs. This is subject to some conditions, as set out below.

 

Our goodwill guarantee.

In addition, we, Lazer Lamps Ltd of Calder House, Central Road, Harlow, Essex CM20 2ST, offer our UK customers a goodwill guarantee for most products however they are purchased, which is more generous than your legal rights in the ways set out below. This goodwill guarantee does not affect your legal rights if there is something wrong with your product (for more on those rights see ‘You have rights if there is something wrong with your product’).


Your legal rights: How our goodwill guarantee is more generous:
14 days to change your mind (online and telephone sales only) (provided it has not been used or fitted to a vehicle). 30 days to change your mind, however you bought the product (provided it has not been used or fitted to a vehicle).

 

 

When you can't change your mind:

  • Services we provide to you such as fitting a grille integration kit once this has been done or we have started work.
  • Products that have been used or fitted to a vehicle.
  • Bespoke goods that are made to your specifications or are clearly personalised.

The deadline for changing your mind.

If you change your mind about a product you must let us know no later than 30 days after:

  • The day we deliver it, if your order is for goods only. If your purchase is split into several deliveries over different days, the period runs from the day after the last delivery.
  • The day we confirm we have accepted your order if it is for a service, for example fitting a grille integration kit.

 

How to let us know.

To let us know you want to change your mind, visit the Returns section of our website or call us on +44 (0)1992 677374, sales@lazerlamps.com, or write to us and post it to us at; Calder House, Central Road, Harlow, Essex CM20 2ST.

 

You have to return the product at your own cost.

You have to return your product to us within 14 days of your telling us you have changed your mind. You will need to send the product back to us using an established delivery service. If you do this you should keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it. If you don’t do this and we don’t receive the goods at all or within a reasonable time we won't refund you the price. If you have bought a service such as fitting a grille integration kit, we won’t refund you if we have already started work before you told us you had changed your mind.

 

We reduce your refund if you have used or damaged a product.

If you handle the product in a way which would not be acceptable ‘in-store’, we reduce your refund, to compensate us for its reduced value. For example, we reduce your refund if the product's condition is not "as new", price tags have been removed, the packaging is damaged or accessories are missing. In some cases, because of the way you have treated the product, no refund may be due.

 

When and how we refund you.

If you tell us you've changed your mind about a product that hasn't been delivered or one that we're collecting from you, we refund you as soon as possible and within 14 days. If you're sending your product back to us, we refund you within 14 days of receiving it (or receiving evidence you've sent it to us).

We refund you by the method you used for payment. We don't charge a fee for the refund.

 

You have rights if there is something wrong with your product.

If you think there is something wrong with your product, you must contact our Customer Service Team: sales@lazerlamps.com and +44 (0)1992 677374. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law. Your legal rights are summarised below. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk. Remember too that you have several options for resolving disputes with us.

 

Summary of your key legal rights:

The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

  • Up to 30 days: if your goods are faulty, then you can get a refund.
  • Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.
  • Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

 

As well as your key legal rights, Lazer offers additional product guarantees:


Lens Replacement: We offer a lifetime lens guarantee on all our lights. This guarantee only applies where the products have been used in the manner for which they were intended. The guarantee covers replacement of any lenses which have become cracked as a result of stone impact. The guarantee doesn’t cover replacement of lenses where the surface of the lens has become mottled, faded or stone chipped. When you apply for a replacement lens you must provide proof of purchase to our Customer Service team before you send the product back to us. You are responsible for the costs of returning the product to us and the costs of delivering back to you after replacement of the lens, including any associated import/export duties/taxes. If a lamp has become damaged internally due to water ingress arising from a cracked lens, the lens can still be replaced, but you must contact our Customer Service team before you ship the product to us so that we can advise you on whether or not the repair will result in a functional product.


Extended Warranty:

  • Driving Lights (this means all our Lights other than Utility Lights): They all have a 5 (five) year warranty that they are free from any defect in material or workmanship from the date they were delivered to you.
  • Utility Lights: Where the end fitment is an automotive application, have a 5 (five) year warranty that they are free from any defect in material or workmanship from the date they were delivered to you.
  • Utility Lights (and Linear 24 Flood): Where the end fitment is an automotive application, have a 5 (five) year warranty that they are free from any defect in material or workmanship from the date they were delivered to you.
  • All Lights: All Lazer lights have a 2 (two) year warranty that their visual appearance will not be materially affected by blemishes, corrosion, or colour fading/changes, unless this results from an external factor such as a collision.

 

To make a claim under our extended warranty.

You must tell us in writing within the two or five year warranty period by email or by post to warranty@lazerlamps.com or Customer Services, Calder House, Central Road, Harlow, Essex CM20 2ST and send us a copy of your purchase receipt. We will ask you to return the product to us at your own cost.

If we accept your claim under the extended warranty we will replace or repair, without charge, the defective product OR refund the price you paid if we are satisfied that the conditions we have set out here are met.

 

This warranty does not cover:

  • The joint between the lamp connector and the vehicle side connector, because this depends on installation variables which are outside our control.
  • Products where it is evident the breather membrane has been removed or tampered with.
  • Products where a repair has been attempted without prior discussion and agreement with us.
  • Products where replacement parts have been fitted incorrectly
  • Labour costs associated with warranty replacements.
  • Damage caused by an external factor such as a collision.

 

We can change products and these terms.


Changes we can always make:

  • To reflect changes in relevant laws and regulatory requirements.
  • To make minor technical adjustments and improvements. These are changes that don't affect your use of the product.

 

Changes we can only make if we give you notice and an option to cancel.

We can also make the types of change explained below to the product or these terms, but if we do so we'll notify you and you can then contact our Customer Service Team: sales@lazerlamps.com or +44 (0)1992 677374 to cancel your order before the change takes effect and receive a refund for any products you've paid for, but not received.

 

We can suspend supply (and you have rights if we do).


We can suspend the supply of a product. We do this to:

  • Deal with technical problems or make minor technical changes.
  • Update the product to reflect changes in relevant laws and regulatory requirements.
  • Make changes to the product (see We can change products and these terms).

 

We let you know, may adjust the price and may allow you to terminate. We contact you in advance to tell you we're suspending supply, unless the problem is urgent or an emergency. If we suspend the product for longer than 2 weeks in any 6 month period, we adjust the price so you don't pay for it while its suspended. If we suspend supply, or tell you we're going to suspend supply, for more than 2 weeks, you can contact our Customer Service Team: sales@lazerlamps.com or +44 (0)1992 677374 to end the contract and we'll refund any sums you've paid in advance for products you won't receive.

 

We can withdraw products.

We can stop providing a product at any time.

 

We can end our contract with you.

We can end our contract with you for a product and claim any compensation due to us (including enforcement costs) if you don't make any payment to us when it's due and you still don't make payment within 14 days of our reminding you that payment is due.

 

We don't compensate you for all losses caused by us or our products.

We're responsible for losses you suffer caused by us breaking this contract unless the loss is:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
  • Caused by a delaying event outside our control. As long as we have taken the steps set out in the section above explaining when we may suspend supplying the product(s) to you, we’re not responsible for delays outside our control.
  • Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.
  • A business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession.

You have several options for resolving disputes with us.

You can go to court.

These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

 

Other important terms apply to our contract.


We can transfer our contract with you, so that a different organisation is responsible for supplying your product.

We'll contact you to let you know if we plan to do this. If you're unhappy with the transfer you can contact our Customer Service Team: sales@lazerlamps.com or +44 (0)1992 677374 to end the contract within 2 working days of us telling you about it and we will refund you any payments you've made in advance for products not provided.


You can only transfer your contract with us to someone else if we agree to this.

We may not agree for various reasons, which may include a situation where the new owner is based in a territory where we do not have an authorised distributor, where we are unable to arrange carriage to an alternative location at a comparable cost to that agreed by you, or where that third party is ineligible for any discounted pricing previously offered. However, you can transfer our guarantee (as explained in Our Goodwill Guarantee) to a new owner of the product. We can require the new owner to prove you transferred the product to them, for example by supplying the original proof of purchase.

 

Nobody else has any rights under this contract.

This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.


If a court invalidates some of this contract, the rest of it will still apply.

If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

 

Even if we delay in enforcing this contract, we can still enforce it later.

We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
